Compulsory Drug Rehabilitation



Preamble

Whereas the State of Washington recognizes the severe public health crisis posed by drug addiction and homelessness, it is the intent of this legislation to provide comprehensive and compassionate care to individuals suffering from substance use disorders. This bill aims to address the root causes of drug addiction and homelessness, ensuring that affected individuals receive the necessary support and treatment to reintegrate into society. It is imperative that we balance supportive measures with firm accountability to protect both individuals and the community at large.


Section 1: Title

This Act shall be known as the "Compulsory Drug Rehabilitation and Support Act."


Section 2: Definitions

For the purposes of this Act:

1. Substance Use Disorder (SUD): A medical condition characterized by an inability to stop using a substance despite harmful consequences.

2. Homeless Individual: A person who lacks a fixed, regular, and adequate nighttime residence.

3. Compulsory Drug Rehabilitation: Mandated treatment for individuals diagnosed with substance use disorders, which may include detention and outpatient services.

4. Evaluation/Assessment Process: A comprehensive process to determine the necessity of involuntary rehabilitation based on medical and psychological criteria.

5. Wraparound Support Services: Comprehensive, individualized services designed to address various aspects of an individual's needs, including housing, mental health, employment, and social integration.

6. Outpatient Treatment: Non-residential treatment services provided to individuals recovering from substance use disorders.


Section 3: Evaluation and Assessment Process

1. Initiation of Evaluation:

- Law enforcement officers may conduct screenings in public spaces when there is reasonable suspicion that an individual is under the influence of illegal drugs.

- If drugs are detected, officers can refer individuals to an approved medical facility for a comprehensive evaluation within 24 hours.


2. Evaluation Criteria:

- A qualified medical professional shall conduct the evaluation to determine the presence of a substance use disorder.

- The evaluation shall include medical, psychological, and social assessments.


3. Detention for Rehabilitation:

- Individuals diagnosed with a substance use disorder may be detained for up to 72 hours for further assessment.

- Following the assessment, individuals may be ordered to undergo compulsory drug rehabilitation for a period deemed necessary by medical professionals.


Section 4: Rehabilitation and Treatment

1. Inpatient Rehabilitation:

- Individuals mandated to rehabilitation shall be provided with comprehensive inpatient treatment, including medical detoxification, counseling, and psychiatric care.

- The duration of inpatient rehabilitation shall be determined based on individual needs but shall not exceed 180 days without further evaluation.


2. Outpatient Treatment and Step-Down Process:

- Upon completion of inpatient rehabilitation, individuals shall transition to outpatient treatment programs.

- Outpatient treatment shall include regular drug testing, counseling, and wraparound support services.

- Failure to comply with outpatient treatment requirements may result in a return to inpatient care or criminal charges.


Section 5: Wraparound Support Services

1. Comprehensive Support:

- Individuals in outpatient treatment shall receive assistance with housing, employment, education, and mental health services.

- Support services shall be tailored to individual needs to facilitate successful reintegration into society.


Section 6: Health Insurance Coverage

1. Mandatory Coverage:

- All health insurance providers operating in Washington State shall cover the costs of both inpatient and outpatient drug rehabilitation services.

- Insurance coverage shall include all necessary medical, psychiatric, and support services as part of the treatment plan.


Section 7: Enforcement and Compliance

1. Non-Compliance:

- Individuals who fail to comply with the mandated rehabilitation process shall be subject to criminal charges, including potential incarceration.

- Probation officers shall oversee individuals in outpatient treatment to ensure compliance with rehabilitation requirements.


Section 8: Implementation and Funding

1. Funding:

- The State shall allocate necessary funds to support the implementation of this Act, including the establishment of rehabilitation centers, training of personnel, and provision of support services.

- Grants and partnerships with non-profit organizations may be pursued to supplement state funding.


Section 9: Severability

If any provision of this Act or its application to any person or circumstance is held invalid, the remainder of the Act, including the application of such provision to other persons or circumstances, shall not be affected thereby and shall continue in full force and effect.


Section 10: Effective Date

This Act shall take effect 90 days after its passage and approval by the Governor.
